Terms of Service
1. Parties and scope
These terms govern access to the MADD LLM API at llm.madd.im (the "API"), provided by MADD Marcin Kisielinski, ul. Kajki 10-12, 10-547 Olsztyn, Poland, VAT ID (NIP) PL7422297084 ("MADD"). The API is intended for businesses and developers. If you use it as a consumer, mandatory consumer law applies in addition to these terms; by starting to use purchased credits immediately you acknowledge that the right of withdrawal ends once the service has been fully performed for the credits used. A separate written agreement with a customer takes precedence over these terms.
2. Access
Access requires an account at llm.madd.im and an API key created in it, or a key issued by MADD under a separate agreement. The customer keeps its keys secret and is responsible for all usage made with them, including usage after a key leaks until it is revoked. MADD may suspend a key or account that is used in breach of these terms or that endangers the service.
3. Acceptable use
The customer will not use the API to break the law, to infringe the rights of others, to generate content that sexually exploits minors, to attack or overload the API, or to resell access in breach of the model licences. The models are open-weight models used under their respective licences, listed with each model.
4. Pricing and payment
Prices are stated in US dollars per million tokens, net of VAT, and published in the model catalog and in the /v1/models endpoint. Usage is measured by MADD's token counts and the cost of each request is returned in the response.
Accounts are prepaid. The customer tops up its balance by card (minimum 5 USD). The amount of the top-up is credited to the balance; VAT is added on top where applicable: 23% Polish VAT for customers in Poland and for customers in other EU countries without a VAT ID confirmed in VIES, reverse charge for EU businesses with a confirmed VAT ID, and no Polish VAT for customers outside the EU. MADD issues a VAT invoice for each top-up and sends it by e-mail. Requests are charged against the balance; when the balance reaches zero the API returns HTTP 402. Credits do not expire while the account is active. Unused credits are refunded on request when the account is closed, less any payment fees, and the invoice is corrected accordingly. A customer with a separate agreement (for example a marketplace) may be invoiced monthly in arrears instead.
Price changes apply to requests made after the change is published. Credits already purchased keep their dollar value.
5. Availability
MADD aims for continuous availability but does not guarantee it unless agreed in writing. Under load the API may reject requests with HTTP 429 instead of queueing them. MADD may change the list of models and their parameters.
6. Data
Customer content is handled as described in the Data Policy: it is not stored and never used for training. Personal data is handled as described in the Privacy Policy.
7. Outputs and liability
Model outputs are generated automatically and may be inaccurate. The customer is responsible for how it uses them. To the extent permitted by law, MADD's total liability is limited to the fees paid for the API in the three months before the event giving rise to the claim, and MADD is not liable for lost profits or indirect damages.
8. Term
The customer may close its account at any time in the dashboard. MADD may end the service with 30 days notice by e-mail and will refund unused credits. Fees for usage already made remain payable.
9. Law and disputes
These terms are governed by Polish law. Disputes will be resolved by the court competent for MADD's registered address, unless mandatory law provides otherwise.
